Royal Cornwall Hospital pays £62,000 for pregnancy termination error

A Royal Cornwall Hospital Trust (RCHT) patient who lost a baby during an operation has received £62,000 compensation from the Trust.

The unnamed woman was undergoing a hysterectomy operation to remove her uterus in November 2007, when the foetus was found. She had not known that she was pregnant.

Charlotte Skouby of solicitors Leigh Day & Co said:

"Following the removal of our client's cervix a 14-week old foetus was discovered and the pregnancy diagnosed at which point, tragically, the pregnancy was no longer viable.

"The responsible NHS trust admitted the fact of the inadvertent termination and that the diagnosis of the pregnancy could and should have been made at the point when it was still viable, thus enabling our client to go on to term and deliver a much wanted baby boy."

Alison Millar, Partner at Leigh Day & Co, added:

"This was a very unusual and obviously devastating case which has caused great distress to our client. We are very glad to have secured a settlement for them which recognises their injuries and enables them now to close this most unhappy chapter of their lives".

RCHT Chief Executive, Lezli Boswell, said: "I am deeply sorry to hear about any anxiety, pain or distress caused to our patients."

The compensation announcement follows revelations that 1500 patients of RCHT gynaecology consultant, Rob Jones, are having their cases reviewed. The consultant has since resigned and removed his name from the medical register. RCHT has set up an advice line for concerned patients on 0800 180 4514.
